Website Terms of Use and Service

Verity Metabolic Health LLC

These Terms of Use and Service govern access to veritymetabolichealth.com and related online services offered by Verity Metabolic Health LLC, including appointment requests, intake forms, patient portal access, telehealth links, educational content, and administrative communications. By accessing or using these services, you agree to these Terms. If you do not agree, do not use the website or related online services.

These Terms are not a consent to medical treatment and do not replace Verity’s telemedicine consent, consent to treatment, Notice of Privacy Practices, financial policy, medication-specific disclosures, or other patient forms. Those documents apply when relevant and control if they conflict with these Terms on matters involving clinical care, health information, or patient financial responsibility.

About Verity and the Scope of These Terms

Verity Metabolic Health LLC is a New Mexico-based virtual medical practice that provides individualized weight-management and metabolic-health services. Services may include clinical evaluation, lifestyle counseling, laboratory review, medication management, and follow-up care. References to “Verity,” “we,” “us,” or “our” mean Verity Metabolic Health LLC and, where appropriate, its clinicians, staff, and authorized contractors.

These Terms apply to the public website and to electronic tools Verity makes available for care and administration. Separate terms from a patient portal, telehealth platform, laboratory, pharmacy, payment processor, form provider, or other third party may also apply to that service.

Eligibility and Service Area

You must be at least 18 years old to use the website independently. A parent or legal guardian may use the website on behalf of a minor only when Verity has agreed to evaluate or treat the minor and all legally required consent and authorization requirements are satisfied.

Clinical services are currently intended for patients who are physically located in New Mexico at the time care is provided, unless Verity confirms otherwise. You must accurately disclose your physical location at each telehealth visit. Verity may decline or discontinue services when a clinician is not authorized to practice where you are located, when telehealth is not clinically appropriate, or when applicable legal or professional requirements cannot be met.

No Emergency Services

The website, online forms, email, text messages, and patient portal are not emergency services and are not monitored continuously. If you believe you are experiencing a medical or psychiatric emergency, call 911 or go to the nearest emergency department. Do not wait for a response from Verity. For urgent but non-emergency concerns, contact an appropriate local health care professional or urgent care facility.

Health Information Is Not Individual Medical Advice

Public website content, social-media content, newsletters, downloads, and educational materials are provided for general information only. They do not diagnose a condition, recommend treatment for a particular person, or replace individualized advice from a qualified health care professional who knows your medical history.

Viewing the website, following Verity on social media, submitting a general question, or completing an appointment or qualification request does not by itself create a clinician-patient relationship. A clinical relationship begins only after Verity accepts you for care, verifies required information, completes an appropriate clinical evaluation, and obtains the necessary consents and agreements.

Telehealth Services

Telehealth uses electronic communications to provide care when the patient and clinician are in different locations. Telehealth can improve access and convenience, but it has limitations, including technology failure, incomplete information, reduced ability to perform a physical examination, privacy risks, and the possibility that in-person evaluation or testing may be needed.

You agree to participate from a reasonably private, safe location; use a device and connection suitable for the visit; provide your current physical location and an emergency contact when requested; and avoid driving or operating equipment during a visit. Verity may stop a virtual visit and recommend in-person care when clinically appropriate.

Clinical Decisions and Treatment

All evaluation and treatment decisions are based on the clinician’s independent professional judgment, the information available, applicable standards of care, and legal requirements. Verity does not guarantee that you will qualify for treatment, receive a prescription, obtain insurance authorization, receive a particular medication or dose, or achieve a specific result.

A clinician may require laboratory testing, medical records, identity verification, vital signs, pregnancy testing, an in-person examination, specialist input, or coordination with another health care professional before initiating or continuing treatment. A clinician may change, pause, or discontinue a treatment when medically indicated or when safe monitoring is not possible.

Prescriptions Laboratories and Pharmacies

Prescriptions are issued only when a licensed clinician determines that treatment is clinically appropriate. Completing a form, paying a professional fee, requesting a medication, or having previously used a medication does not guarantee that a prescription will be issued, renewed, or continued.

Laboratories and pharmacies are separate entities. They may charge separate fees and may apply their own privacy, fulfillment, refund, shipping, and service terms. Verity will use reasonable efforts to coordinate clinically appropriate orders but cannot guarantee laboratory scheduling, pharmacy inventory, insurance coverage, prior authorization, shipping time, delivery, or uninterrupted availability. Contact Verity promptly if an ordered medication or test is delayed, damaged, incorrect, or unavailable so the clinical team can advise you.

Compounded Medications

When clinically appropriate and legally permitted, a clinician may discuss a compounded medication as one possible treatment option. Compounded medications are not approved by the United States Food and Drug Administration. The FDA does not review compounded drugs for safety, effectiveness, or quality before they are marketed. Compounded medications may have risks that differ from FDA-approved products, and additional medication-specific disclosures and informed consent may be required before treatment.

Verity does not manufacture or dispense compounded medication. The dispensing pharmacy is responsible for compounding, labeling, packaging, storage instructions, and fulfillment, while Verity remains responsible for its clinical prescribing and monitoring decisions. Report suspected side effects, dosing concerns, or product-quality problems promptly. Seek emergency care for severe or life-threatening symptoms.

Your Responsibilities

To support safe and effective care, you agree to:

  • Provide complete, current, and accurate identity, contact, location, health, medication, allergy, pregnancy, laboratory, and insurance information.
  • Tell the clinician about other prescribers, pharmacies, medications, supplements, adverse reactions, new diagnoses, emergency visits, hospitalizations, and material changes in your health.
  • Follow dosing, storage, monitoring, laboratory, follow-up, and safety instructions and ask questions when instructions are unclear.
  • Use medication only as prescribed and never share, transfer, resell, or misuse medication.
  • Attend required follow-up visits and complete required monitoring. Failure to do so may make continued prescribing unsafe or unavailable.
  • Maintain an appropriate relationship with local primary and emergency care resources. Verity’s focused services do not replace comprehensive primary care.

Fees Payment and Financial Responsibility

Professional fees, payment timing, cancellation rules, medication costs, laboratory costs, and other charges are described at scheduling, checkout, or in Verity’s current program-cost and financial-responsibility information. Fees may change prospectively. The price of a professional service pays for clinical time and work; it does not guarantee a prescription, insurance approval, medication availability, or a particular health outcome.

Unless Verity expressly agrees otherwise, you are responsible for all charges. You are also responsible for determining whether your health plan will reimburse any service, medication, or test. Verity does not guarantee insurance coverage or reimbursement.

A balance that remains unpaid for more than seven calendar days may be assessed a $25 late fee when permitted by law and the applicable financial policy. A missed appointment may be assessed a $25 no-show fee. Verity may require payment of outstanding professional fees or applicable administrative charges before scheduling non-urgent follow-up services or sending a medication order or refill, subject to clinical judgment, continuity-of-care duties, and applicable law. Medication will be ordered only when clinically appropriate.

Refunds, credits, rescheduling, and cancellation decisions are governed by the policy disclosed when the service is scheduled or purchased. Charges imposed directly by a laboratory, pharmacy, shipping provider, payment processor, or other third party are subject to that party’s terms.

Electronic Communications and Patient Portal

You consent to receive service-related electronic communications, including appointment confirmations, reminders, portal notices, billing messages, and care-coordination messages, using the contact information you provide. Message and data rates may apply. Marketing communications, if any, require any additional consent required by law, and you may opt out of nonessential marketing without affecting your eligibility for care.

Email and standard text messaging may not be fully secure. Avoid sending sensitive clinical information through unsecured channels when a secure portal or approved form is available. You are responsible for safeguarding portal credentials, using accurate contact information, reviewing messages and instructions, and notifying Verity promptly of suspected unauthorized access. Do not allow another person to use your account unless that person is your legally authorized representative and Verity has documented the authorization when required.

Privacy and Health Information

Verity’s website Privacy Policy explains general website data practices. Verity’s Notice of Privacy Practices separately explains how protected health information may be used and disclosed and describes applicable patient rights. These Terms do not authorize any use or disclosure of health information beyond what is permitted by applicable law and Verity’s privacy notices.

No internet transmission or electronic storage method is completely secure. Verity uses reasonable administrative, technical, and physical safeguards appropriate to the information and services involved, but cannot promise absolute security.

Third Party Services and Links

The website and care process may link to or depend on services operated by third parties, including patient portals, telehealth platforms, online forms, payment processors, laboratories, pharmacies, shipping providers, social-media platforms, and external educational resources. A link or integration does not mean Verity controls or endorses every aspect of the third party’s services. Your use of those services may be governed by separate terms and privacy practices.

To the extent permitted by law, Verity is not responsible for a third party’s independent acts, omissions, outages, security practices, product fulfillment, or content. This provision does not reduce Verity’s own duties concerning clinical care, vendor selection, health information, or other obligations imposed by law.

Acceptable Use

You may use the website and related services only for lawful personal health care and informational purposes. You may not:

  • Provide false information, impersonate another person, or access another person’s records without legal authority.
  • Attempt to bypass security, interfere with operation, introduce malicious code, scrape or harvest data, or test vulnerabilities without written authorization.
  • Use the services to obtain medication through fraud, diversion, resale, or other unlawful conduct.
  • Copy, republish, sell, or commercially exploit Verity content except as permitted by law or with written permission.

Verity may restrict or suspend website or portal access when reasonably necessary to protect patients, staff, systems, legal compliance, or the integrity of services. Any termination of a clinician-patient relationship will be handled separately in accordance with professional and legal obligations.

Intellectual Property

The website and its original text, graphics, logos, photographs, downloads, layout, and other content are owned by or licensed to Verity and are protected by applicable intellectual-property laws. Verity grants you a limited, revocable, nonexclusive, nontransferable license to view and use the website for personal, noncommercial purposes. No other rights are granted.

Website Availability and Disclaimers

The website and general educational content are provided on an “as available” basis. To the fullest extent permitted by law, Verity disclaims implied warranties concerning the operation, availability, accuracy, or fitness of the public website for a particular purpose. Verity may correct errors, modify content, or temporarily suspend online features without notice.

These website disclaimers do not disclaim or reduce any professional standard of care, informed-consent duty, privacy obligation, product responsibility, or other duty that cannot lawfully be limited. Clinical services are governed by applicable professional standards and the specific agreements and consents relevant to your care.

Limitation of Liability

To the fullest extent permitted by law, Verity will not be liable for indirect, incidental, special, exemplary, or consequential damages arising solely from use of, or inability to use, the public website or from a third party’s independent service. This limitation does not apply to professional negligence, willful misconduct, gross negligence, violation of privacy or health-information laws, or any liability or remedy that cannot lawfully be excluded or limited.

Responsibility for Misuse

To the extent permitted by law, you are responsible for losses or claims caused by your unlawful misuse of the website, fraudulent information, unauthorized access to another person’s account, or violation of another person’s rights. This section does not require you to indemnify Verity for Verity’s own negligence, unlawful conduct, or breach of professional duties.

Governing Law and Disputes

These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles, except when federal law controls. Before filing a claim concerning the website or administrative services, you are encouraged to contact Verity so the concern can be reviewed and, when possible, resolved. Unless applicable law permits or requires another forum, legal proceedings concerning these Terms will be brought in a court with jurisdiction in Bernalillo County, New Mexico. Nothing in this section limits a patient’s right to contact a licensing board, government agency, health plan, privacy regulator, or other authority.

Changes to These Terms

Verity may update these Terms to reflect changes in services, technology, law, or business practices. The revised version will be posted with a new effective date. Changes apply prospectively when posted unless a different date is stated. Material changes affecting existing patient care or financial obligations may also be communicated through the portal, email, or an updated patient agreement when appropriate.

General Terms

If any provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. Verity may assign these Terms as part of a lawful reorganization, merger, sale, or transfer of the practice, subject to applicable health-information and patient-notice requirements. You may not assign your rights to access patient-specific services without written permission.

These Terms, together with policies expressly incorporated by reference, are the entire agreement concerning use of the public website and related general online services. They do not replace or amend the clinical and privacy documents that govern patient care.
